When is the Bill effective?
On August 30, 1997, Governor Whitman signed the law establishing the Petroleum Underground Storage Tank Remediation, Upgrade and Closure Fund (UST Fund) within the New Jersey Economic Development Authority (NJEDA) and administered jointly with the New Jersey Department of Environmental Protection (NJDEP).
The UST Fund provides loans and grants to eligible owners and operators of regulated and non-regulated petroleum underground storage tanks to help finance project costs for the remediation of discharges from regulated and non-regulated underground storage tanks.
Am I an eligible applicant?
Eligible owners and operators of a business with regulated tanks that:

- Own or operate <10 petroleum underground storage tanks in NJ;
- Have a net worth of less than $2 million; and
- Can demonstrate the inability to obtain a commercial loan (two bank denial letters)
- Homeowners with leaking underground home heating oil tanks
- Public entities that own or operate underground storage tanks (only eligible for loans)
- Tax-exempt, non-profit organizations with less than 100 paid employees
- Duly incorporated volunteer fire, ambulance, first aid, emergency or rescue companies
- Independent colleges and universities of NJ

How can I qualify for a grant award?
In order to qualify for a conditional hardship grant, homeowner applicants must meet the following criteria:

- A taxable income of less than $250,000
- A personal net worth, exclusive of applicant’s primary residence and pension (401K, IRA’s), of less than $500,000
- A determination of financial hardship which will be based on whether an applicant can reasonably be expected to repay if the funding were to be awarded as a loan.

When is the Bill effective?
The Hazardous Discharge Site Remediation Fund (HDSRF) was established in July 1993 in conjunction with the Industrial Site Recovery Act to provide funding to public entities (municipalities, counties, and redevelopment agencies), qualifying private entities (businesses, corporations, homeowners, etc.) and non-profit organizations for the investigation and/or remediation of a suspected or known discharge of a hazardous substance. In 2003, the HDSRF received additional funding through an appropriation and permanent allocation of monies for loans and grants to the program. In September 2005, the HDSRF was expanded through amendments to the Statute to increase the availability of grants and loans to public entities, private entities, and non-profit organizations described in section 501(c)(3) of the federal internal revenue code.
Am I an eligible applicant?
Innocent party grants
Grants are available to private entities that meet the criteria outlined below for remediation of real property where the applicant is not a responsible party:

- The property was acquired by the applicant before December 31, 1983
- The hazardous substance or hazardous waste that was discharged at the property was not used by the applicant
- The applicant certifies that he did not discharge any hazardous substance or hazardous waste at an area where a discharge is discovered

An applicant that meets all three criteria may be eligible for up to 50% of costs for PA, SI, RI, and RA costs not to exceed $1 million.
